Relating to provider discrimination against a Medicaid recipient or child health plan program enrollee based on immunization status.

This bill prohibits providers participating in Medicaid or the child health plan program from refusing to provide health care services to a Medicaid recipient or child health plan program enrollee based solely on the recipient's or enrollee's refusal or failure to obtain a vaccine or immunization for a particular infectious or communicable disease. However, the bill allows providers to adopt a policy requiring some or all of their patients to be vaccinated or immunized against a particular infection or communicable disease, as long as they provide an exemption for Medicaid recipients or child health plan program enrollees based on a reason of conscience or a recognized medical condition. The bill also requires the state Medicaid agency to withhold reimbursement from providers who violate this provision, but only for the individual physician who violated the law, not the entire provider group or medical organization.
