This bill prohibits providers participating in Medicaid or the child health plan program from refusing to provide health care services to an individual based on the individual's refusal or failure to obtain a vaccine or immunization for a particular infectious or communicable disease. The bill requires the Health and Human Services Commission to withhold Medicaid or child health plan program reimbursement from providers who violate this prohibition and to disenroll them from participating as a provider. The bill also allows the executive commissioner to adopt rules necessary to implement this new law, and delays implementation of any provision that requires a federal waiver or authorization until such waiver or authorization is granted.
