This bill prohibits owners associations from banning the installation of solar energy systems, with some exceptions. It defines key terms like "covenant and restriction of a real estate development" and "solar energy system." The bill allows owners associations to include certain restrictions on solar energy systems, such as those that threaten public health/safety, are located on common property, or exceed certain size/placement requirements. It also requires owners associations to approve solar energy system installations if the provisions of their instrument are met, unless the proposed placement would substantially interfere with the use and enjoyment of neighboring properties. The bill takes effect on November 1, 2023.
