This bill prohibits the knowing and reckless promotion of unlawful or false material in New York State, and provides remedies for violations of this prohibition. It defines "knowingly" and "recklessly" in accordance with the Penal Law, and prohibits the promotion of content that advocates for the use of force or self-harm, or includes false statements of fact or fraudulent medical theories that are likely to endanger public safety or health. The bill also declares such violations as a public nuisance and allows the Attorney General or local city corporation counsel to bring legal action to enjoin violations and obtain restitution and damages. Additionally, it provides for a private right of action for anyone damaged by a person's violation of the law.
