Bill Summary

AN ACT to amend the environmental conservation law, in relation to the sale of cosmetic products containing trace amounts of mercury

AI Summary

This bill amends the Environmental Conservation Law to allow the sale of cosmetic and personal care products containing trace amounts of mercury that are identified by the Department of Environmental Conservation, in consultation with the Department of Health, as being unavoidable under good manufacturing practices or necessary for use as a preservative when no effective and safe non-mercurial alternative is available, particularly for products intended for use around the eye area. The bill also provides for a waiver process for manufacturers seeking to reduce 1,4-dioxane in their products and unable to meet the current requirements.
