This bill amends the Environmental Conservation Law to allow the sale of cosmetic and personal care products containing trace amounts of mercury, as identified by the Department of Environmental Conservation in consultation with the Department of Health. These trace amounts must be consistent with the permissible concentrations allowed by the Food and Drug Administration as either unavoidable under good manufacturing practices or necessary as a preservative where an effective and safe non-mercurial alternative is not available, especially for products intended for use around the eyes. The bill also clarifies the definition of "mercury" for the purposes of this regulation.
