This bill amends the Executive Law to require contracting agencies to contact minority-owned and women-owned business enterprises (MWBEs) that are listed on a utilization plan when awarding a contract. It mandates that the prime contractor use the MWBEs identified on the utilization plan, unless the MWBE cannot perform the work or is no longer state-certified. The bill also adds new provisions, such as requiring the prime contractor to execute a subcontractor agreement and provide work assignments to the listed MWBEs within 45 days of the contract award, and making payments to the MWBEs within 20 days of receiving payment from the contracting agency. Failure to comply with these requirements can result in the disqualification of the prime contractor and the re-awarding of the contract.
