It mandates that the prime contractor use the M/WBEs identified on the utilization plan, unless the M/WBE cannot perform or is no longer state-certified. The bill also sets timelines for the prime contractor to execute subcontractor agreements, make payments to M/WBEs, and allows M/WBEs to notify the contracting agency of any payment violations. Additionally, it allows prime contractors that are certified M/WBEs to self-certify and perform under the contract to meet the M/WBE goals.
