This bill amends the Penal Law to eliminate the requirement that an incarcerated individual must cause or attempt to cause an employee to come into contact with blood, seminal fluid, urine, feces, saliva, or the contents of a toilet bowl by throwing, tossing, or expelling such fluid or material in order to be guilty of aggravated harassment of an employee. The bill retains the requirement that the incarcerated individual must have the intent to harass, annoy, threaten, or alarm the employee, but removes the specific method of contact. The bill applies to incarcerated individuals or detainees in correctional facilities, local correctional facilities, hospitals, and secure facilities operated by the Office of Children and Family Services.
