This bill amends the Real Property Actions and Proceedings Law to establish conditions precedent to the bringing of certain actions or proceedings. Specifically, it requires that at the time of commencement of a proceeding, there must be no violations of applicable state, city, or local codes relating to housing maintenance or housing standards, no conditions that contravene the Real Property Law, and no lack of heat, water, electricity, or other hazardous conditions in the subject apartment or common areas of the building. If such conditions do exist, the landlord may still commence a proceeding by filing an affidavit establishing that the violations were recorded erroneously or that a government agency failed to remove them. The bill also requires the petition to state that these conditions are met or that the affidavit has been filed.
