This bill amends the Real Property Actions and Proceedings Law to establish additional conditions precedent for bringing certain actions or proceedings. Specifically, it requires that at the time of commencement of the proceeding, there are no violations of any applicable state, city, or local codes relating to housing maintenance or housing standards, no conditions that contravene the Real Property Law's provisions on habitability, and no extremely hazardous violations in any apartments in the subject building. If such conditions exist, the landlord must file an affidavit establishing that the violations were recorded erroneously or that a government agency failed to remove them. The bill also requires the petition and notice of petition to state these conditions or the filing of the affidavit.
