This bill amends the civil practice law and rules to allow a plaintiff, who has obtained a judgment against a defendant, to directly recover the unsatisfied portion of that judgment from a co-defendant or third-party defendant that has been found liable to the original defendant for contribution or indemnification. The bill also allows the plaintiff to attach or take an assignment of the original defendant's cause of action for contribution or indemnification against the co-defendant or third-party defendant, and prosecute that claim in the plaintiff's own name. This new law applies to all judgments entered by plaintiffs on or after the effective date.
