This bill, the Nogales Wastewater Improvement Act of 2023, provides for the assumption of full ownership and control of the International Outfall Interceptor (IOI) in Nogales, Arizona, by the International Boundary and Water Commission (IBWC). The bill amends the Act of July 27, 1953 to limit the City of Nogales, Arizona's share of the Nogales sanitation project to the costs directly associated with the treatment and conveyance of the city's wastewater, excluding costs related to wastewater originating in Mexico. The bill requires the IBWC to enter into agreements with local governing bodies in Arizona to assume full ownership and control of the IOI, and authorizes funding for the IBWC to operate and maintain the IOI, as well as construct and operate a debris screen to intercept drug bundles and other illicit goods. The bill also limits the applicability of the Federal Tort Claims Act to any claims arising from the IBWC's activities in carrying out the provisions of the bill.
