This bill, known as the "Manufacturer Disclosure and Transparency Act," requires prescription drug manufacturers doing business in New York to notify the Attorney General if they enter into any arrangement with another manufacturer that has the purpose or effect of delaying or preventing the introduction of a generic substitute for the drug. The notification must include details like the drug's name, wholesale price, the disease it treats, the manufacturers involved, and the length of the delay. The Attorney General is required to share this information with the Drug Utilization Review Board, Medicaid managed care plans, health carriers, and pharmacy benefits managers, and to post the notices publicly on the Attorney General's website. Manufacturers who fail to comply can be fined up to $10,000 per violation.
