Bill Summary

AN ACT concerning Real Property - Expedited Wrongful Detainer Proceedings - Property for Sale or Lease FOR the purpose of requiring certain expedited proceedings in a wrongful detainer action if the property that is the subject of the action is, at the time of the complaint, advertised or listed for sale or lease by the complainant and requiring that notice of a hearing or appeal be served in person or, under certain circumstances, posted conspicuously on the property; requiring the District Court or the circuit court to issue a warrant within a certain number of hours if the court rules in favor of the complainant in an expedited wrongful detainer action; and generally relating to a wrongful detainer action for possession of real property. BY repealing and reenacting, with amendments, Article - Real Property Section 14-132 Annotated Code of Maryland (2015 Replacement Volume and 2022 Supplement)

AI Summary

This bill expedites the wrongful detainer proceedings for real property that is advertised or listed for sale or lease at the time the complaint is filed. It requires the District Court to immediately summon the person in possession, issue a ruling within 2 days, and if the complainant prevails, issue a warrant to the sheriff within 24 hours to execute the order. The bill also sets expedited timelines for any appeals to the circuit court. The changes aim to provide a faster resolution when property owners are seeking to regain possession of real estate they are actively trying to sell or lease.
