This bill establishes the crime of "aggravated harassment by means of electronic or digital communication," which involves producing, distributing, publishing, or broadcasting material that contains a picture, photograph, or image of a person or a "deep fake" - a digitized image that alters a person's face or identifiable body part onto an image depicting pornographic or lewd acts or graphic violence, without the person's explicit written permission. It also amends the Civil Rights Law to provide a private right of action for the unlawful dissemination or publication of such "deep fakes," as well as for the unlawful dissemination or publication of intimate images or sexually explicit depictions of an individual without their consent.
