This bill amends the Environmental Conservation Law to increase penalties for repeat violators who endanger public health, safety, or the environment. It creates a new crime of "endangering public health, safety or the environment in the fourth degree" for those who have previously committed certain environmental crimes within the last 10 years. The bill also increases the penalties for repeat offenders of the existing crimes of "endangering public health, safety or the environment in the third, second, and first degrees." Additionally, the bill expands the definitions of "unlawful dealing in hazardous wastes or substances" to include substances that are hazardous or acutely hazardous to public health, safety, or the environment.
