Bill Summary

AN ACT to amend the real property law, in relation to requiring the disclosure of lead-based paint test reports in real estate transactions

AI Summary

This bill requires the disclosure of lead-based paint test reports in real estate transactions. Specifically, it mandates that sellers of residential real property must deliver to buyers a certificate indicating the property has been tested for lead-based paint, and provide the report of such test, prior to the signing of a binding contract of sale. The bill also requires sellers to submit the certificate and test report to the county office that registers property titles and the state Department of Health's lead inspection registry. The bill includes exceptions for certain types of property transfers, and allows sellers to deduct the cost of lead testing from their taxes in certain cases. The bill also requires landlords to disclose any lead-based paint reports to tenants, and imposes penalties for non-compliance.
