Bill Summary

AN ACT to amend the real property law, in relation to requiring the disclosure of lead-based paint test reports in real estate transactions

AI Summary

This bill: Requires sellers of residential real property built before 1978 to have the property tested for lead-based paint and provide the results of the test to the buyer before the buyer signs a binding contract of sale. The bill also requires sellers to submit the test results to a state-run registry of lead inspections to help prevent lead poisoning in children. The bill provides some exceptions to the testing requirement, such as for transfers to certain family members or between co-owners. The bill imposes duties on real estate agents to inform sellers and buyers of these requirements and mandates disclosure of lead-based paint test results to tenants of rental properties. The bill allows buyers to pursue existing legal remedies if they discover lead-based paint hazards after purchasing a property.
