This bill aims to provide protection from child enticement. It amends the existing law by adding a new subsection (c) to Section 26C of Chapter 265 of the General Laws. The new subsection prohibits any person, without privilege, from knowingly enticing a child under the age of 16 to enter into any vehicle, unless the person has the express or implied permission of the child's parent, guardian, or legal custodian, and the person is not a law enforcement officer, emergency services provider, firefighter, or other person who regularly provides emergency services, or is not affiliated with a nonprofit or religious organization that provides activities for children. The bill provides an affirmative defense if the person acted in response to a bona fide emergency or to preserve the health, safety, or welfare of the child. Violations of this new subsection can result in imprisonment or a fine.
