This bill aims to provide legal protections for "Good Samaritans" who assist others in determining if a controlled substance contains harmful substances, or who monitor the consumption of pre-obtained controlled substances to reduce disease transmission and prevent overdose deaths. Specifically, the bill adds two new subsections to the existing law: (1) a person acting in good faith may provide, administer, or use a controlled substance testing product, such as fentanyl test strips, without being charged for possession of the controlled substance, and (2) a person acting in good faith to clinically monitor the consumption of pre-obtained controlled substances to reduce risks and prevent overdoses shall not be arrested, charged, or penalized. Additionally, the bill exempts supplies obtained at public health programs from the existing restrictions on the sale of hypodermic needles and syringes.
