This bill aims to provide continuity of care for mental health treatment by amending the state's insurance laws. It introduces a new definition of "continuing course of treatment" to mean having at least one visit in the past four months for the same or similar mental health diagnosis or symptoms. The bill also allows patients engaged in a continuing course of treatment with a licensed mental health provider who is involuntarily or voluntarily disenrolled, other than for quality or fraud reasons, to continue treatment with that provider through an out-of-network option. The carrier must reimburse the provider the usual network rate, and the patient's additional costs, if any, must be justified and approved by the state's health care finance and policy division.
