This bill amends the fourth paragraph of section 8A of chapter 239 of the General Laws, which relates to rent escrow. If a summary process action (eviction case) is continued for any reason, the court must require the tenant to deposit the amount due for use and occupancy each month or as required by the rental agreement, including any amount due from the start of withholding, into an escrow account pending final disposition of the case. The amounts held in escrow will first go towards repairs. If the tenant fails to comply with the deposit order, the court will schedule the matter for a bench trial at the earliest date and make further orders as deemed appropriate.
