This bill, known as the Baby Food Protection Act, requires the Pennsylvania Department of Health to test baby food manufactured in the state for the presence of toxic heavy metals such as inorganic arsenic, lead, cadmium, and mercury. The bill sets limits on the levels of these toxic heavy metals allowed in baby food, and if the U.S. Food and Drug Administration sets lower limits, the department must adopt those federal limits. Additionally, the bill requires all tested baby food to be labeled with the levels of these toxic heavy metals found in the product. The department is also tasked with promulgating any necessary rules and regulations to carry out the provisions of the act. The bill will sunset if federal legislation is enacted that regulates the testing, labeling, or limits on toxic heavy metals in baby food, and the secretary determines the state law is substantially similar to the federal law.
