This bill, known as the BPA-free Container Products for Infants Act, prohibits the manufacture, sale, or distribution of any container intended for use by infants that contains bisphenol A (BPA) above 0.1 parts per billion. Manufacturers must use the least toxic alternative when replacing BPA and are prohibited from using carcinogens or reproductive toxicants. Violations of this law constitute unfair methods of competition and unfair or deceptive acts or practices under the Unfair Trade Practices and Consumer Protection Law, subjecting violators to enforcement provisions, civil penalties, and private rights of action. The bill takes effect 60 days after enactment.
