The key provisions require these districts to abide by the terms of any collectively bargained agreements with the contracting entity governing disciplinary actions, unless the district superintendent certifies that the driver or assistant engaged in egregious misconduct that created a clear and present danger. In such cases, an expedited fact-finding process must be completed within five business days, and any driver or assistant who incurs a diminution in wages may be entitled to punitive damages if the superintendent's determination is improper or they are exonerated.
