This bill amends the education law to detail the procedure that certain school districts in Westchester, Putnam, Nassau, and Suffolk counties must follow when dealing with disciplinary actions against bus drivers and bus drivers' assistants. The key provisions are: 1) these districts must abide by the terms of any existing collective bargaining agreements governing disciplinary actions against bus drivers and assistants employed by the contracting entity, unless the district superintendent certifies the conduct constituted egregious misconduct posing a clear danger; 2) if the superintendent makes such a certification, an expedited fact-finding process must be completed within 5 business days; and 3) any driver or assistant who incurs a wage reduction may be entitled to punitive damages if the superintendent's determination is improper or they are exonerated.
