This bill would amend the general municipal law to add a new section 207-r, which would provide a presumption that any condition of impairment of health caused by diseases of the lung, resulting in total or partial disability or death, for certain deputy sheriff members of a retirement system in cities with a population of one million or more, was incurred in the performance of duty. The bill would also provide that such deputy sheriff members retiring due to such a condition would receive a pension equal to three-quarters of their final average salary, and that retired members who would have been eligible for this benefit if the law had been in effect at the time of their retirement would have their pensions recalculated accordingly.
