This bill amends the New York Public Health Law to change the way the operating cost component of Federally Qualified Health Center (FQHC) rates of payment are calculated and adjusted. The bill extends the current methodology, which ties the operating cost component to the Medicare Economic Index, through September 30, 2025. After that, the operating cost component will be calculated based on an analysis of actual FQHC costs over the prior 5-year period, considering factors like scope of services, staffing needs, physical plant costs, and technology costs. The bill also requires the Department of Health to develop and issue updated FQHC payment rates reflecting these actual costs, without the imposition of any payment ceilings or caps, as long as the payments remain subject to federal financial participation.
