AN ACT to amend the public health law, in relation to federally qualified health center rate adequacy

This bill amends the Public Health Law to extend the period for which the operating cost component of federally qualified health center (FQHC) rates of payment shall reflect the operating cost component in effect on September 30th of the prior period, as increased by the Medicare Economic Index, from September 30, 2001 through September 30, 2025. After September 30, 2025, the operating cost component shall be calculated consistent with newly established rates of payment, and then annually adjusted using the FQHC Market Basket inflator. Additionally, the bill requires the Department of Health to analyze the actual FQHC costs filed over the prior five-year reporting periods and consider various factors in developing and issuing updated rates of payment reflecting the actual costs and updated aggregated data, without any ceilings or caps on such payments, provided they are still subject to federal financial participation.
