This bill amends the New York Public Health Law to prohibit the sale of disposable electronic cigarettes, also known as "disposable e-cigarettes." The bill defines a "disposable electronic cigarette" as any electronic cigarette that cannot be refilled with vapor products. It imposes a civil penalty of up to $100 for each individual package of disposable electronic cigarettes sold or offered for sale, with an affirmative defense for manufacturers who can show the sale occurred without their knowledge or involvement. The bill also allows any person to submit a complaint to an enforcement officer about a violation of this section. The bill will take effect 30 days after it becomes law.
