This bill amends the public health law to prohibit the sale of disposable electronic cigarettes, also known as disposable e-cigarettes, in the state of New York. The bill defines a "disposable electronic cigarette" as any e-cigarette or vaping device that cannot be refilled with vapor products. Any person, firm, or business that violates this prohibition will be subject to a civil penalty of up to $100 per individual package of disposable e-cigarettes sold or offered for sale. The bill also provides an affirmative defense for manufacturers if the sale occurred without their knowledge, consent, or involvement. The law will take effect 30 days after it becomes law.
