This bill creates the offense of engaging in an adult cabaret performance. An adult cabaret performance is defined as a performance in a location other than an adult cabaret (a commercial establishment that regularly features semi-nude performers) that features topless dancers, exotic dancers, strippers, or similar entertainers. The bill makes it a class A misdemeanor for a first offense and a class E felony for any second or subsequent offense to engage in such a performance on public property or in a location where it could be viewed by someone who is not an adult. The bill also preempts any conflicting local ordinances or regulations adopted prior to August 28, 2024 and prevents or preempts local governments from enacting other conflicting ordinances or regulations in the future.
