This bill modifies guidelines for student participation in athletic contests organized by sex. It requires private and public schools and postsecondary institutions to only allow students to compete in athletics competitions that match their biological sex as stated on their birth certificate or other government record, except that a female student may compete in a male competition if no corresponding female competition is offered. The bill also establishes enforcement mechanisms, such as withholding state funding for violations and providing a private right of action for students deprived of athletic opportunities. The bill requires the Departments of Elementary and Secondary Education and Higher Education and Workforce Development to promulgate rules to ensure compliance with state and federal law regarding student medical information confidentiality.
