This bill amends Florida Statute 487.081 to specify circumstances under which products liability actions, including failure to warn claims, cannot be brought against distributors, dealers, or applicators of pesticides. The bill states that such actions are not allowed unless the distributor, dealer, or applicator exercised substantial control over the design, testing, manufacture, or labeling of the product; altered or modified the product in a way that substantially caused the harm; handled, used, or applied the product inconsistently with the label; or the manufacturer is not subject to the jurisdiction of Florida. The bill takes effect on July 1, 2024.
