This bill, known as the Defend the Guard Act, creates a new section in the Kentucky Revised Statutes (KRS) Chapter 38 to restrict the use of the Kentucky National Guard outside of state active duty. The bill stipulates that the Kentucky National Guard and its members cannot be deployed for active duty combat unless the federal government has satisfied any outstanding balance to the Kentucky National Guard, and the U.S. Congress has either passed an official declaration of war or taken official action to explicitly call forth the Kentucky National Guard for specific purposes, such as executing the laws of the Commonwealth, repelling invasion, or suppressing insurrections. The bill does not limit the Governor's ability to consent to the deployment of the Kentucky National Guard for defense in support of civil authority missions within the United States or its territories.
