Bill Summary

This bill would permit the governing body of a municipality in which there is located a decommissioned nuclear power plant in which spent nuclear fuel is stored, by ordinance, to impose a stranded nuclear waste fee on the owner of the decommissioned nuclear power plant for every calendar year in which spent nuclear fuel is stored in the decommissioned nuclear power plant. The amount of the annual fee would be equal to the number of kilograms of spent nuclear fuel stored at the decommissioned nuclear power plant multiplied by the fee per kilogram established in the ordinance. The fee per kilogram could not exceed $15. The use of the annual fee would be limited to reducing the municipal property tax levy.

AI Summary

This bill allows municipalities that have a decommissioned nuclear power plant storing spent nuclear fuel on-site to create a local law, called an ordinance, to charge the owner of that plant a fee each year the spent nuclear fuel remains stored there. The fee is calculated by multiplying the amount of spent nuclear fuel in kilograms by a rate per kilogram, which the municipality sets in its ordinance, but this rate cannot be more than $15 per kilogram. The money collected from this fee can only be used by the municipality to lower its property tax collection.
