This bill provides that, in the case of an automobile accident in which the primary insurer has not yet been determined, an automobile insurer may act as the primary insurer and then pursue a claim against a health insurer if the insured has selected the health insurer as the primary coverage for medical expense benefits. Under the bill, if injuries are sustained in an automobile accident by an insured, subsequent to the selection of the health insurance coverage or benefits as primary option by the named insured pursuant to current law, an automobile insurer: (1) shall provide the health insurance coverage or benefits carrier with notice of the insured's coverage selection; and (2) may provisionally assume the role of primary coverage provider, while retaining the right to file a claim against the health insurance coverage or benefits carrier to recover any amounts which would have been paid by the health insurance coverage or benefits carrier if the carrier had acted as the primary insurer, plus reasonable attorneys' fees and court costs.
