Bill Summary

The bill extends the time period required for public notice of certain land use applications from 10 days to 21 days. Currently, section 7.1 of P.L.1975, c.291 (C.40:55D-12) requires a developer to give written notice of a public hearing concerning certain applications for property development at least 10 days prior to the scheduled public hearing to owners of all real property within 200 feet in all directions of the property for which the public hearing is being held in addition to the following people and entities in certain circumstances: the clerk of any municipality located within 200 feet of the subject property; the County Planning Board; the New Jersey Commissioner of Transportation; the State Planning Commission; and public utilities, cable television companies, or local utilities. The bill amends section 7.1 of P.L.1975, c.291 (C.40:55D-12) to require that notice of public hearings be given at least 21 days before the scheduled public hearing.

AI Summary

This bill amends the existing law in New Jersey to extend the required time period for public notice of certain land use applications from 10 days to 21 days. The bill applies to public hearings regarding applications for property development, such as extensions of approvals, modifications to conditions in a prior approval, and other types of development applications (except for conventional site plan review, minor subdivisions, and final approvals). The increased notice period is intended to provide more time for affected property owners and other interested parties to be informed and participate in the public hearing process.
