This bill amends existing New Jersey law to clarify and expand prevailing wage requirements for public institutions of higher education, ensuring that workers on construction projects for these institutions receive fair wages. Specifically, it clarifies that "public work," which is subject to prevailing wage laws, now includes projects undertaken by or for the benefit of a public body through an associated for-profit or not-for-profit entity, such as a university foundation, and also covers work paid for through "take-out financing" (long-term loans used to replace short-term construction loans) provided by a public body. The bill also introduces a new provision stating that public institutions of higher education must pay prevailing wages for construction projects intended for their use at the time of construction, and if they violate these prevailing wage laws, they will be subject to the established penalties. Additionally, it clarifies that prevailing wage requirements apply to public-private partnership agreements for construction, reconstruction, repair, alteration, improvement, extension, management, or operation of facilities for State or county colleges, including when the project is intended for the college's use at the time of construction. Finally, it ensures that workers on facilities constructed or rehabilitated with financial assistance from the New Jersey Educational Facilities Authority, when intended for use by a public institution of higher education, are also paid prevailing wages.
