This bill amends the existing state law to require that the U.S. Congress must either issue a formal declaration of war or take official action to call forth the South Dakota National Guard before the federal government can deploy them for active service in an armed conflict in a foreign nation, for hazardous service related to an armed conflict in a foreign nation, or to execute the laws of the Union, repel an invasion, or suppress an insurrection. This additional requirement is intended to limit the federal government's ability to deploy the South Dakota National Guard without explicit Congressional approval.
