This bill amends existing law to prohibit the dissemination of certain criminal history background information by the State Bureau of Identification when an expungement order, which is a legal process to seal or destroy criminal records, has been granted but not yet fully processed. Specifically, if the Bureau receives a request for criminal history information and there is an unprocessed expungement order for the individual, the Bureau must still respond to the request but must exclude any information that has been ordered expunged, and importantly, must not even mention that an expungement order exists. This change aims to ensure that individuals whose records have been expunged are not negatively impacted by the continued disclosure of that information, even if the administrative process to update all records is not yet complete.
