Bill Summary

This bill removes an exemption from the law regulating patient referrals. In general, N.J.S.A.45:9-22.5 provides that a practitioner shall not refer a patient for a medical procedure to a health care service in which the practitioner or the practitioner's immediate family has a significant beneficial interest. N.J.S.A.45:9-22.5 exempts certain medical procedures from the above prohibition. This bill amends N.J.S.A.45:9-22.5 to remove the following medical procedure from the statute's exemption list: "medically-necessary intraoperative monitoring services rendered during a neurosurgical, neurological, or neuro-radiological surgical procedure that is performed in a hospital."

AI Summary

This bill amends a New Jersey law that generally prohibits healthcare practitioners from referring patients to health care services in which they or their immediate family have a significant financial interest, meaning a substantial ownership or investment stake. Specifically, this bill removes an existing exemption that allowed such referrals for medically-necessary intraoperative monitoring services, which are services provided during surgery to monitor a patient's neurological function, when performed in a hospital during neurosurgical, neurological, or neuro-radiological procedures. By removing this exemption, the bill aims to prevent potential conflicts of interest where a doctor might refer a patient to a service they financially benefit from, even if that service is performed in a hospital setting.
