This bill requires health care employers, such as hospitals and ambulatory surgical facilities, to adopt and implement policies that mandate the use of surgical smoke evacuation systems during any procedure that is likely to generate surgical smoke. The bill defines "surgical smoke" as the gaseous by-product produced by energy-generating devices and "smoke evacuation system" as equipment that effectively captures and filters the smoke at the site of origin. The bill will be enforced by the commissioner under existing occupational safety and health laws, and violations will be subject to the penalties provided in those laws. The bill will take effect on January 1, 2025.
