This bill requires health care employers, such as hospitals and ambulatory surgical facilities, to adopt and implement policies that prevent exposure to surgical smoke by requiring the use of a smoke evacuation system during any surgical procedure that is likely to generate surgical smoke. The bill defines "surgical smoke" as the gaseous by-product produced by energy-generating devices, and "smoke evacuation system" as equipment that effectively captures and filters surgical smoke at the site of origin before it makes contact with the eyes or respiratory tract of occupants in the room. The bill will be enforced by the commissioner under existing occupational safety and health laws, and violations will be subject to the penalties provided under those laws. The bill is effective starting January 1, 2025.
