This bill amends the Environmental Conservation Law to provide liability protection for producers, representative organizations, and retailers who participate in a carpet collection program approved by the Department. Specifically, it states that these entities shall not be liable for any claims of antitrust, restraint of trade, or unfair trade practices arising from their actions undertaken solely to increase the collection and recycling of carpet, as long as those actions do not involve price-fixing, limiting output, restricting geographic areas or customers, or unreasonably denying a producer's participation in the program. The Department is also authorized to consider potential restraints on trade when approving or rejecting a proposed plan or plan amendment under the law.
