AN ACT to amend the environmental conservation law, in relation to extended producer responsibility for carpet

This bill amends the Environmental Conservation Law to provide liability protection for producers, representative organizations, and retailers participating in a carpet collection program approved by the New York Department of Environmental Conservation. The bill states that these entities shall not be liable for antitrust, restraint of trade, or unfair trade practice claims arising from actions undertaken solely to increase the collection and recycling of carpet under the approved program. However, the liability protection does not apply to agreements that establish carpet prices, limit output, restrict geographic areas or customers, or unreasonably deny a producer the opportunity to participate in the program. The Department may also consider whether a proposed plan or plan amendment would unduly restrain trade when reviewing and approving such plans.
