This bill amends Chapter 160 of the General Laws to add a new section regarding police reports involving railroad fatalities. The key provisions are: (1) police reports and communications between police officers and railroad crew members related to railroad fatalities shall not be made public and shall be kept confidential by the responding police department; (2) these reports shall be accessible upon written request to the host railroad, the railroad employing any employee mentioned in the report, and anyone authorized by judicial order if access is necessary for their duties; (3) the reports shall also be accessible upon written or email request to law enforcement officers, district attorneys, and assistant district attorneys; (4) communications between police and railroad employees about the incident may be shared with the parties listed in (2); and (5) a violation of these confidentiality provisions is punishable by up to 1 year in prison and/or a fine of up to $10,000.
