This bill requires owners, producers, distributors, or manufacturers of solar and photovoltaic energy generation facilities to remove and recycle or refurbish these facilities after they are no longer in use. The New Jersey Department of Environmental Protection is authorized to develop rules and regulations for this process, which may include a fee schedule to cover implementation costs and requirements for securely storing toxic solar panel components that cannot be safely recycled. The department will be responsible for evaluating the accessibility of recycling facilities for solar equipment within the state and publishing findings when such facilities become widely available. Once recycling facilities are determined to be accessible, facility owners will have 180 days to comply with the removal and recycling requirements. Violations of these provisions will be treated as violations of the Solid Waste Management Act, potentially subjecting violators to associated penalties. The bill takes effect immediately, allowing the department to begin preparing implementation guidelines right away.
