This bill adds seven substances to the general prohibition on adulterated commercial food. Under the State Sanitary Code (pursuant to N.J.S.A.26:1A-7), it is unlawful for any entity in this State to distribute, sell, manufacture for sale or distribution, or possess with intent to sell or distribute, any adulterated food. It is the sponsor's understanding that the State Sanitary Code provides the enforcement and penalties for this act to be carried out by the Department of Health. Each violation of the State Sanitary Code constitutes a separate offense and is punishable by a penalty of not less than $50 and not more than $1,000. This bill adds azodicarbonamide, brominated vegetable oil, butylated hydroxyanisole, potassium bromate, propylparaben, red dye 3 (also known as red 3), and titanium dioxide to the conditions that deem food adulterated. Butylated hydroxyanisole is classified by the National Toxicology Program as "reasonably anticipated to be a human carcinogen." All others are prohibited from use in processed foods for sale in the European Union, based on scientific studies demonstrating their risk for significant public health harm, particularly to children.
